Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GearPost mobile app, website, and related services (the "Service"), operated by Henyogames, LLC ("Henyogames," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you're using GearPost on behalf of a business, you agree on its behalf and represent that you're authorized to do so.
1. The Service
GearPost is a tool for managing equipment rentals — inventory, availability, rentals, deposits, returns, reminders, contracts, and reporting. It is a record-keeping and operations tool. It is not a bank, payment processor, escrow service, or accounting or legal advisor.
2. Accounts
You must provide accurate information and keep your login credentials secure. You're responsible for all activity under your account and for your staff's use of it. Notify us promptly of any unauthorized use. You must be at least 18 years old to use the Service.
3. Acceptable use
You agree not to:
- Break the law or infringe others' rights using the Service;
- Send messages (including SMS) without the recipient's required consent;
- Upload malware, attempt to breach or overload the Service, or access data that isn't yours;
- Reverse engineer, resell, or copy the Service except as allowed by law;
- Use the Service to store unlawful, harmful, or fraudulent content.
4. Your data & your customers
You retain ownership of the data you put into GearPost ("Your Content"), including your inventory, rentals, and customer records. You grant us a limited license to host, process, and transmit Your Content solely to provide the Service.
You are responsible for the data you collect about your own customers and for having any consent or legal basis required to store it and to send SMS reminders to it. You agree to comply with all laws applicable to your business, including consumer-protection and messaging-consent rules (for example, obtaining consent before sending text reminders). 5. Deposits & payments
GearPost helps you record deposits and rental amounts (cash, check, or card) and their status. Except where you explicitly use an integrated card processor (e.g. Stripe), GearPost does not move money, hold funds, or process payments — those transactions happen between you and your customer. You are solely responsible for collecting, refunding, holding, or forfeiting deposits in line with your own rental agreements and applicable law.
6. Plans & billing
GearPost offers a free tier and paid plans. Paid subscriptions are billed in advance on a recurring basis (monthly or annually) and renew automatically until canceled. Fees are non-refundable except where required by law. We may change prices with reasonable notice; changes take effect at your next renewal. Failure to pay may result in suspension or downgrade of paid features. Taxes are your responsibility where applicable.
7. Availability & offline use
GearPost is designed to work offline, with data syncing when connectivity returns. We don't guarantee uninterrupted or error-free operation of the server-side components, and sync depends on your device and connection. You are responsible for keeping your device and app reasonably up to date.
8. Intellectual property
The Service, including its software, design, and trademarks (including the GearPost name and logo), is owned by Henyogames, LLC and protected by law. These Terms don't grant you any rights to our branding except as needed to use the Service normally.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that data will always sync without loss. You are responsible for maintaining your own backups where that matters to your business.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEARPOST WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR USD 100 IF YOU USE only the free tier).
11. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or create risk or legal exposure for us. On termination, your right to use the Service ends; we'll make your data available for export for a reasonable period unless prohibited by law.
12. Changes to these Terms
We may update these Terms from time to time. When changes are material, we'll update the "Last updated" date and, where appropriate, notify you in the app or by email. Continued use after an update means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of the United States and the State in which Henyogames, LLC is organized, without regard to its conflict-of-laws rules. Where required, disputes will be resolved in the state or federal courts located there. Nothing here removes consumer-protection rights you may have under your local law.
